Terms of Service

Welcome to TextYourCRM. These Terms of Service ("Terms" or "Agreement") constitute a legally binding agreement between you (whether an individual trade contractor, sole proprietor, or corporate entity, referred to as "Contractor," "User," or "you") and TextYourCRM ("TextYourCRM," "we," "us," or "our").

By accessing our website (textyourcrm.io), registering an account, sending messages through our SMS gateway, or utilizing our hosted Twenty CRM database instances, you agree to be bound by these Terms. If you do not agree to all terms and conditions, you must not use our services.

1. Description of the Service

TextYourCRM provides an intelligent messaging-to-CRM software platform designed for field trades and contractors. The Service includes:

  • An SMS telephony gateway enabling contractors to manage customer pipelines and log job data via standard text messaging.
  • Spoken voice note transcription converting field audio into itemized proposals.
  • Automated generation of branded PDF estimates, proposals, and invoices with localized sales tax estimation.
  • A dedicated, fully hosted instance of Twenty CRM for client and pipeline record management, accessible via mobile messaging and desktop web browsers.
  • Automated follow-up reminders and job site photo synchronization.

2. Eligibility & Account Security

You must be at least 18 years old and operate a bona fide trade contracting or service business to use TextYourCRM. By subscribing, you represent and warrant that you possess the legal authority to bind your business to this Agreement.

You are responsible for designating authorized mobile phone numbers ("Whitelisted Numbers") permitted to interact with your CRM assistant. Any command, message, or document generation triggered from a Whitelisted Number associated with your account will be deemed authorized by you. You must notify us immediately if a team member's device is lost, stolen, or reassigned.

3. Contractor Verification & Quote Review Responsibility

Mandatory Review Requirement: TextYourCRM assists in formatting and drafting proposals based on the instructions you provide. You expressly agree that you are solely responsible for reviewing, verifying, and approving every line item, material description, price, labor calculation, and state or local sales tax before submitting any estimate or invoice to a homeowner or customer. TextYourCRM is not an engineering, architectural, or licensed contracting authority and does not warrant the structural accuracy or legal completeness of trade estimates.

TextYourCRM bears no liability for pricing errors, under-quoted jobs, typographical mistakes, or contractual disputes arising between you and your clients.

4. SMS Messaging Terms & Carrier Compliance (A2P 10DLC)

By providing your mobile telephone number and utilizing TextYourCRM, you explicitly consent to receive operational SMS and MMS text messages from TextYourCRM relating to your account, estimate previews, and system notifications.

  • Transactional Use: The SMS bridge is designed for operational business communications. You agree not to use the bridge to send unsolicited commercial marketing or spam in violation of the Telephone Consumer Protection Act (TCPA).
  • Cancellation (STOP): You can cancel SMS notifications at any time by texting STOP to our dedicated number. You will receive one confirmation message, after which SMS notifications will cease.
  • Help (HELP): Text HELP to our dedicated number at any time for assistance or email support@textyourcrm.io.
  • Fees: TextYourCRM does not charge per-text surcharges beyond your plan limits, but standard carrier message and data rates may apply according to your wireless contract.
  • Delivery Disclaimer: Wireless carriers are not liable for delayed, dropped, or undelivered messages.

5. Subscription Plans, Billing & Cancellations

TextYourCRM offers subscription plans as detailed on our pricing page:

  • Solo Plan: $149/month. Includes 1 dedicated SMS texting seat, full hosted Twenty CRM database, and unlimited branded PDF generation.
  • Team Plan: $299/month. Includes up to 3 dedicated SMS texting seats, shared CRM pipeline, and multi-truck photo sync. Additional seats are billed at $49/month per technician.

A. Recurring Billing

Subscriptions are billed in advance on a monthly recurring basis via our secure payment processor (Stripe). Your subscription will renew automatically each month unless canceled prior to the renewal date.

B. No Long-Term Contracts & Cancellation

You may cancel your subscription at any time directly through your account dashboard or by contacting support. Upon cancellation, your service will remain active until the end of the current paid billing cycle. We do not provide prorated refunds for partial months of service.

C. Usage Limits & Monthly Seat Message Allotment

To maintain optimal mobile carrier throughput (A2P 10DLC compliance) and avoid carrier spam-filtering, each dedicated SMS seat is subject to a sending limit of 1,200 messages per month (one SMS seat can only send up to 1,200 messages/month). The Solo Plan includes 1 seat (up to 1,200 messages/month), and the Team Plan includes 3 seats (up to 3,600 messages/month pooled across the 3 seats). Each additional field technician seat added at $49/month includes an allotment of 1,200 messages/month. In the event an account reaches its monthly seat allotment, outbound dispatch may be paused until the start of the next billing cycle, or billed at standard domestic carrier overage rates ($0.03 per standard message) with prior notification.

6. Ownership of Data & Intellectual Property

A. Your Data

You retain sole and exclusive ownership of all customer data, contact records, estimates, price books, and job site photos uploaded to or generated through your Twenty CRM instance. We claim no intellectual property rights over your customer lists. You grant us only the limited license necessary to host, process, and transmit this data to provide the Service.

B. TextYourCRM Intellectual Property

All software code, database architecture, design systems, logos, user interfaces, documentation, and the TextYourCRM name are the exclusive intellectual property of TextYourCRM. You may not reverse engineer, decompile, copy, or resell the platform.

7. Acceptable Use Policy

You agree not to use the Service to:

  • Transmit unlawful, harassing, fraudulent, defamatory, or obscene communications.
  • Violate the TCPA, CAN-SPAM Act, or any state or federal telecommunications regulations.
  • Harvest or scrape customer contact data without proper authorization.
  • Attempt to breach or probe the security of our messaging bridge or hosted databases.
  • Send messages to individuals who have expressed an unwillingness to receive communications from your business.

Violation of this section may result in immediate suspension or termination of your account without refund.

8. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL SOFTWARE, PDF GENERATION TOOLS, AND HOSTED CRM DATABASES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEXTYOURCRM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM TELECOMMUNICATION DELAYS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TEXTYOURCRM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, BUSINESS INTERRUPTION, OR LOSS OF CLIENT DATA) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THIS AGREEMENT SHALL BE LIMITED TO THE TOTAL FEES ACTUALLY PAID BY YOU TO TEXTYOURCRM DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless TextYourCRM, its affiliates, and its employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) any trade work, installation, or craftsmanship performed by you or your subcontractors; (c) any dispute between you and your clients; or (d) your violation of consumer messaging laws (including the TCPA).

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute or claim arising out of this Agreement shall be resolved through binding confidential arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

12. Modifications to Terms

We reserve the right to revise these Terms at any time. If a revision is material, we will provide at least 15 days' notice via email or SMS notification before new terms take effect. Continued use of the Service following effective notice constitutes your agreement to the modified Terms.
